Abstract
This paper addresses the topic of joint powers agreements used by the cities of Cupertino, Sunnyvale and Mountain View, in Santa Clara County. It examines the minimum content requirements as required by state law and case law as applied to these Agreements. In addition, one Joint Powers Agreement, the Congestion Management Agency, Joint Powers Agreement was studied to determine the positive and negative implications of the Agreement, why this form of Agreement was used and whether the Agreement goal was met effectively.
A summary section provides recommendations to municipal, state, federal or district governments in the development of Joint Powers Agreements. These recommendations are based upon the study of 18 Joint Powers Agreements. The recommendations can be used as guidelines and considerations in the development of an effective Joint Powers Agreement.
